Kleinfeld, Kaplan & Becker advises manufacturers and distributors of consumer products regulated by the Consumer Product Safety Commission (CPSC). We assist clients in evaluating the need for substantial product hazard reports under Section 15(b) of the Consumer Product Safety Act (CPSA) and provide recommendations on product recalls and other corrective actions, as well as how to respond to product inquiries from the CPSC staff concerning possible product defects. We further advise clients on regulatory compliance with other laws administered by CPSC, including the Consumer Product Safety Improvement Act (CPSIA), the Federal Hazardous Substances Act (FHSA), and Poison Prevention Packaging Act (PPPA). Our firm also represents clients in CPSC rulemaking proceedings and judicial review proceedings, which challenge CPSC rules. In addition to aspects of FDA-related products that may be regulated by CPSC (such as containers), we have represented distributors of toys and other children’s products, laundry and cleaning products, electronic products, and candles.
